By downloading, installing, or using Messages: SMS Messenger App (the "App"), you enter into this agreement with Metamorph AI Labs ("we," "our," "us"). Please read it fully before using the App. Continued use signals your acceptance; if you disagree with any part, please discontinue use.

DEFINITIONS

"App" refers to Messages: SMS Messenger App and any related updates, features, or services. "User," "You," "Your" refers to the individual installing or using the App. "Content" refers to any messages, media, or files sent, received, or stored through the App. "Carrier" refers to your mobile network operator providing SMS/MMS and data services.

  1. SCOPE OF SERVICE

The App enables sending and receiving SMS/MMS messages, organizing conversation threads, attaching media files, and customizing notification and display settings. Feature availability may vary based on device and app version.

  1. ELIGIBILITY REQUIREMENTS

☐ You must meet the minimum legal age for using messaging services in your jurisdiction. ☐ If you are a minor under applicable law, a parent or guardian must consent to your use of the App. ☐ You must have the legal capacity to accept these Terms. ☐ You agree to use the App solely for lawful purposes.

  1. DEVICE PERMISSIONS

The App may request:

☐ SMS/MMS access — to send, receive, and display messages ☐ Contacts access — to associate numbers with saved names ☐ Camera/media access — to attach and view shared files ☐ Storage access — to save attachments and local backups ☐ Notification access — to alert you of new messages

Permissions may be revoked at any time via device settings; doing so may limit App functionality.

  1. PROHIBITED CONDUCT

You must not:

☐ send spam, bulk unsolicited messages, or fraudulent content; ☐ harass, threaten, impersonate, or stalk any individual; ☐ transmit unlawful, obscene, or rights-infringing material; ☐ attempt to hack, disrupt, or reverse-engineer the App; ☐ violate any telecommunications or data protection law applicable to you.

Violation of this Section may result in suspension or termination of your access.

  1. OWNERSHIP OF CONTENT

You retain ownership of all Content you send or receive. Metamorph AI Labs does not claim ownership of, and does not routinely access, your private Content. Optional backup or sync features, where offered, are subject to your consent and governed by our Privacy Policy.

  1. CARRIER FEES AND NETWORK DEPENDENCE

The App requires an active SIM and cellular/data connection. Standard Carrier charges for SMS, MMS, or data may apply. Metamorph AI Labs is not liable for Carrier fees, roaming charges, or message delays caused by network conditions outside our control.

  1. INTELLECTUAL PROPERTY

The App's source code, design, trademarks, and branding are owned exclusively by Metamorph AI Labs or its licensors. You receive a limited, non-transferable, revocable license for personal use only. You may not copy, decompile, resell, redistribute, or use our branding without written consent.

  1. THIRD-PARTY INTEGRATIONS

The App may connect with third-party services such as cloud backup providers, sticker packs, or analytics tools, each governed by their own terms and privacy practices outside our control.

  1. PRIVACY

Our data practices are detailed in our separate Privacy Policy, incorporated into these Terms by reference. Use of the App signifies your consent to those practices.

  1. MODIFICATIONS AND MAINTENANCE

Metamorph AI Labs may update, modify, or temporarily suspend the App at its discretion, without prior notice, for maintenance, improvements, or feature changes.

  1. SUSPENSION OR TERMINATION

We may suspend or terminate your access to the App at any time if we determine, in good faith, that you have violated these Terms or engaged in harmful conduct toward other users or Metamorph AI Labs.

  1. DISCLAIMER OF WARRANTIES

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Metamorph AI Labs shall not be liable for indirect, incidental, or consequential damages — including loss of messages, data, or profits — arising from use of the App. This does not affect liability that cannot be lawfully excluded, such as for death, personal injury, or fraud.

  1. AMENDMENTS

These Terms may be revised periodically to reflect changes in features, practices, or applicable law. Material changes will be communicated via the App or its store listing. Continued use after such changes constitutes acceptance.

  1. GOVERNING LAW

These Terms are governed by the laws applicable to Metamorph AI Labs' principal place of business, without regard to conflict-of-law rules.
