TERMS OF SERVICE Messages: Text SMS Messenger

Welcome. This Terms of Service agreement ("Agreement") sets out the rules for using Messages: Text SMS Messenger (the "App"), developed by Metamorph AI Labs ("we," "our," "us," or the "Developer"). By downloading, installing, or opening the App, you agree to everything written in this Agreement. If you don't agree, please don't use the App.

Article I — Scope of the App

Messages: Text SMS Messenger is a mobile messaging tool that allows you to send, receive, and manage SMS and MMS communications. Depending on your device and settings, the App may also offer conversation organization, custom notification sounds, message search, and interface personalization options.

Article II — Eligibility to Use the App

To use the App, you must:

  1. Be of an age at which you can legally use SMS/text messaging services in your country or region;
  2. Have the legal right to enter into agreements such as this one, or have the consent of a parent or guardian if you are a minor;
  3. Use the App only for purposes that comply with applicable laws.

Article III — Permissions the App May Request

For the App to function as intended, it may request access to the following on your device:

  • Default messaging (SMS/MMS) access, to send and display your texts;
  • Contact list access, to identify who you're messaging;
  • Photo, video, and file access, to send and receive attachments;
  • Notification access, to alert you of new activity;
  • Storage access, to save attachments and, if enabled, local backups.

You may revoke any of these permissions through your device settings at any time. Doing so may limit the App's functionality.

Article IV — Responsible Use

While using the App, you agree that you will not:

(a) send unsolicited bulk messages, spam, or fraudulent content; (b) harass, threaten, stalk, or impersonate any person or organization; (c) transmit content that is illegal, defamatory, obscene, or infringing on another party's rights; (d) attempt to interfere with, hack, or reverse-engineer the App or its systems; (e) violate any telecommunications, data protection, or consumer protection law applicable to your use.

Violation of this Article may result in suspension or termination of your access to the App.

Article V — Message Ownership and Handling

You retain ownership of all messages, media, and content you send or receive through the App. Metamorph AI Labs does not claim ownership of, and does not routinely access or review, the content of your personal conversations. Where optional backup, sync, or cloud features are available, their handling of your data is described in our Privacy Policy and requires your consent to activate.

Article VI — Network Dependency and Charges

The App operates using your device's SIM card and cellular/data network. Metamorph AI Labs is not responsible for:

  • Standard SMS, MMS, or mobile data charges billed by your carrier;
  • Delays, failures, or interruptions in message delivery due to network conditions;
  • Compatibility issues arising from your specific carrier, device, or operating system.

We recommend confirming your messaging plan details with your mobile carrier.

Article VII — Intellectual Property

The App's source code, design, interface, trademarks, and associated branding are the exclusive property of Metamorph AI Labs or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes. You may not:

(a) copy, modify, or create derivative works from the App; (b) reverse-engineer, decompile, or disassemble the App; (c) distribute, sell, rent, lease, or sublicense the App; (d) use Metamorph AI Labs' name, trademarks, or branding without prior written consent.

Article VIII — Third-Party Services

The App may incorporate or link to third-party features, including cloud storage, sticker or emoji packs, or analytics providers. Such third-party services operate under their own terms and privacy practices, which Metamorph AI Labs does not control and is not responsible for.

Article IX — Privacy

Our data collection and handling practices are described in our separate Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to the practices outlined there.

Article X — Modifications and Availability

Metamorph AI Labs may, at its sole discretion:

(a) release updates, bug fixes, or new versions of the App; (b) add, remove, or modify features without prior notice; (c) temporarily suspend the App for maintenance or technical reasons.

We do not guarantee uninterrupted or error-free operation of the App at all times.

Article XI — Suspension and Termination

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if we determine, in good faith, that you have violated this Agreement or engaged in conduct that may harm other users, third parties, or Metamorph AI Labs.

Article XII — Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be secure, error-free, or continuously available.

Article XIII — Limitation of Liability

To the extent permitted by applicable law, Metamorph AI Labs shall not be liable for any indirect, incidental, special, or consequential damages — including loss of messages, data, or profits — arising from or related to your use of the App. This limitation does not apply where liability cannot be lawfully excluded, such as for death, personal injury, or fraud.

Article XIV — Changes to This Agreement

We may revise this Agreement periodically to reflect changes in our practices, features, or legal requirements. Material changes will be communicated through the App or its store listing. Continued use of the App after such changes take effect constitutes your acceptance of the revised Agreement.

Article XV — Governing Law

This Agreement is governed by the laws applicable to Metamorph AI Labs' principal place of business, without regard to conflict-of-law principles.
